TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the services provided by Moment to Moment Pictures Inc. ("we," "us," or "our"), including the Creative Compass app and any related websites, tools, or digital products (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not use the Service.

2. Description of Service

The Service includes the Creative Compass app, an AI-powered filming coach that helps creators plan and record video content through customised prompts, and any associated websites, communities, or digital resources operated by Moment to Moment Pictures Inc.

3. Account Access

Access to the Service requires a valid email address. Authentication is handled via magic link — a one-time sign-in link sent to your email. Your account is tied to the email address you registered with. You are responsible for keeping access to that email secure. We are not liable for unauthorised access resulting from a compromised email account.

4. Subscriptions and Billing

4.1 Paid Plans The Creative Compass app offers free and paid subscription tiers (Starter, Premium, and VIP). Paid plans are billed on a monthly or annual basis through Stripe, our third-party payment processor.

4.2 Auto-Renewal Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. By subscribing, you authorise us to charge your payment method on a recurring basis.

4.3 Cancellation You may cancel your subscription at any time via the app: go to Profile → Manage Billing. Cancellation takes effect at the end of your current billing period. You will retain access to your paid tier until that date. We do not offer refunds for partial billing periods.

4.4 Tier Changes Upgrades take effect immediately. Downgrades take effect at the start of the next billing period. If your subscription lapses or is cancelled, your account will revert to the free tier and paid features will become inaccessible.

4.5 Payment Processing All payments are processed by Stripe. We do not store your payment information. Stripe's terms and privacy policy apply to all transactions.

5. Camera, Microphone, and Device Permissions

The Creative Compass app requests access to your device's camera and microphone to enable video recording. By granting these permissions, you authorise the app to access these features solely for the purpose of recording your sessions within the app. Recordings are stored locally on your device and in your device's camera roll. We do not transmit, store, or process your video recordings on our servers.

6. AI-Generated Content

The Service uses artificial intelligence to generate personalised filming prompts and content suggestions based on inputs you provide (such as your niche, audience, and topic). These inputs are sent to Anthropic, our third-party AI provider, for processing. By using the Service, you consent to this processing. We do not sell your inputs or use them to train AI models. Anthropic's privacy policy applies to data processed through their systems.

AI-generated content is provided for creative assistance only. We make no guarantees about the accuracy, completeness, or suitability of any generated output for your specific purposes.

7. Your Use of the Service

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws

Attempt to gain unauthorised access to any part of the Service or its infrastructure

Reverse engineer, decompile, or attempt to extract the source code of the Service

Use the Service to distribute spam, malware, or harmful content

Impersonate any person or entity or misrepresent your affiliation with any person or entity

Interfere with or disrupt the integrity or performance of the Service

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and AI-generated prompt frameworks — are the exclusive property of Moment to Moment Pictures Inc. and are protected by applicable intellectual property laws.

You retain ownership of any content you create using the Service, including video recordings made through the app.

9. Third-Party Services

The Service integrates with third-party platforms including Supabase (authentication and database), Stripe (payments), Anthropic (AI), and GoHighLevel (CRM). Your use of these integrations is also subject to those providers' respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the results or outcomes you may achieve from using the Service.

11. Limitation of Liability

To the fullest extent permitted by law, Moment to Moment Pictures Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the total amount paid by you to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Moment to Moment Pictures Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if we believe you have violated these Terms or engaged in conduct harmful to us, other users, or third parties. Upon termination, your right to use the Service ceases immediately.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this document. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.
